The Garden: Waiver
and Assumption of Risk
Who this is with
This waiver applies every time you book or take part in anything offered by The Garden, online or in person.
The Garden is operated by Eva Blumenfeld, sole proprietor, 1463 Davenport Rd, PMB #883 Toronto, ON, Canada M6H 2H6. In this waiver, "The Garden" includes Eva Blumenfeld and any teacher, guest teacher, substitute, assistant or volunteer who teaches or supports a session.
It covers classes, workshops, mini-immersions, immersions, livestreams and any other session you book through our booking system or join through the membership.l provide the information and written agreement required by law. Your statutory cancellation rights, if any, begin and operate according to the applicable law, regardless of anything in these terms.
The Practice
Kundalini Yoga is physically, mentally and emotionally demanding. Sessions may include:
Postures held for long periods, repetitive movement and dynamic exercises
Vigorous and sustained breathwork, including Breath of Fire and breath retention
Locks (bandhas), mantra, chanting, meditation, gong and deep relaxation
Practices designed to move energy and bring up unconscious material, including depth work during immersions
These practices can bring up strong emotion, old memory, grief, agitation, disrupted sleep or a period of feeling unsettled afterward.
Your health and readiness
I confirm that I have consulted, or have had the opportunity to consult, a doctor or other qualified health professional before taking part. I understand this is especially important if any of the following apply to me:
Pregnancy, recent birth, or trying to conceive
High or low blood pressure, heart disease, or a history of stroke
Epilepsy or any seizure disorder
Glaucoma or recent eye surgery
Surgery, injury or hospitalization in the past twelve months
A respiratory condition, or a spinal, disc, back or neck condition
Treatment for a mental health condition, or a history of psychosis, mania, dissociation or PTSD
Medication that affects blood pressure, heart rate, mood or sleep
I agree to tell my teacher before class about any condition, injury or pregnancy that may affect my practice, and to tell them if it changes. I understand that some practices, including Breath of Fire and strong navel work, are traditionally modified during pregnancy and menstruation.
Assumption of risk
I am taking part voluntarily. I understand that the practice carries risks, including:
Physical injury, such as strains, sprains, muscle soreness or aggravation of an existing condition
Dizziness, light-headedness or fainting, especially during breathwork
Emotional or psychological distress, during or after a session
In person: slips, trips and falls, and the condition of a venue The Garden does not own or control
Online: practising in my own space, where my teacher may not be able to see me
I understand these risks, and I accept them and their consequences, to the extent the law allows.
My responsibilities
I agree to:
Practise within my own limits, take the modifications offered, and rest whenever I need to
Stop immediately if I feel pain, dizziness, faintness, chest tightness, unexpected or concerning shortness of breath, nausea, or any acute physical or emotional distress
Seek medical help without waiting for the session to end if something feels seriously wrong
When practising at home, use a safe space: a clear floor, a stable surface and nothing to fall against
When practising online, not rely on being seen, and speak up or message my teacher if I feel unwell
When practising in person, follow the venue's rules and my teacher's safety instructions
Not medical healthcare
I understand that The Garden offers spiritual and contemplative practice. Its teachers are not physicians, licensed healthcare providers, psychotherapists or counsellors, and nothing offered diagnoses, treats or cures any condition.
The practice does not replace medical or mental health care. If I am in crisis or in active treatment, I will continue to work with a qualified professional. No particular result is promised.
Release of Liability
To the fullest extent permitted by law, I release, waive and discharge The Garden, and agree not to sue it, for any claim for injury, loss or damage arising from my participation, including claims arising from the negligence of The Garden or anyone acting for it. This includes claims arising from the risks I have accepted above, from my failure to follow safety instructions or to disclose relevant information, and from the acts of independent venues and service providers. This release binds me, my heirs and my legal representatives.
This release does not apply where the law does not allow liability to be excluded, and it does not limit any right I have under Ontario consumer protection law or any other law that cannot be waived. This waiver is governed by the laws of Ontario and the federal laws of Canada that apply there, and any claim relating to it will be brought in the courts of Toronto, Ontario. If any part of it is found unenforceable, the rest remains in effect.
Participation
The Garden may decline or end my participation in any session on medical, safety or conduct grounds, including behaviour that disrupts the safety or wellbeing of others.
In-person sessions
I agree to follow the venue's rules and The Garden's guidelines, including removing shoes in practice areas and arriving and leaving on time. I understand that venues may have slippery floors, uneven surfaces and shared equipment.
I will not attend in person if I have symptoms of a contagious illness, such as fever or cough. I understand that The Garden takes reasonable precautions but cannot guarantee an environment free of illness.
I am responsible for my personal belongings. The Garden is not responsible for items that are lost, stolen or damaged.
Photos and recordings
I understand that The Garden photographs, films and records sessions, online and in person, and may use these photos and recordings in replays for members, on its website, in emails, on social media and in other materials that share or promote The Garden. By taking part, I agree that The Garden may use photos and recordings in which I appear for these purposes, without asking me each time and without payment.
If I would rather not appear at all, I can keep my camera off and stay muted, without needing to tell anyone. If I appear in a session and would rather a photo or recording not be used, I can tell my teacher or write to support@thegarden.earth, and The Garden will remove me where practical, though there may be a short delay. The Garden will ask before quoting my words or featuring me in a testimonial.
I agree not to record, photograph or share any part of a session myself.
Age and agreement
I confirm that I am 18 or older. Participants under 18 take part only with a parent or guardian, who signs the separate Consent, Health Disclosure and Assumption of Risk Form for Participants Under 18.
This waiver forms part of The Garden's Terms & Conditions, which also apply to my booking. I have read it carefully and understand it. I understand that by agreeing to it, I am giving up legal rights, including my right to sue, and that it binds my heirs and legal representatives.
